The laws of the Netherlands Antilles assign a lot of authority
to the Civil Law Notary. The Notary of the Netherlands Antilles
(like in almost all countries where Emperor Napoleon had a
decisive influence on laws) is a neutral official, who
studied notary law in the Kingdom of the Netherlands and who is
appointed by the Government to his office.
The Civil Law Notary is an
official who has the prerogative by law for the following
activities:
- The
transfer of real estate properties (with the obligation to
do title research);
- the
incorporation of legal entities like corporations,
foundations, private foundations, cooperative associations
and many other transactions related with legal entities,
like amendments to the articles of incorporation;
- deeds
of partition of real estate properties;
- mortgages
on real estate properties;
- last
wills and testaments;
- pre-nuptial
agreements;
- the rendering
of legal opinions regarding the entitlement to an estate of
a deceased person (instead of a decision of the court like
in many other countries
